Terms & Conditions
Reservations:
A non-refundable deposit according to conditions of each supplier along with
a completed and signed application form, will secure your Landfall Dive &
Adventure Travel program. The balance of the trip is due 60 days prior to
departure. This does not apply to airfare. Late booking fee of 25.00 per
person will be added for passengers booking within 30 days of departure.
CANCELLATION AND REFUND POLICY:
Notification of cancellation must be received in writing by Landfall Dive &
Adventure Travel. At the time we receive your written cancellation, the
following penalties will apply: more than 60 days prior to departure: Loss
of deposit subject to individual supplier policy, PLUS $100.00 per person
ADMINISTRATION FEE for Landfall Dive & Adventure Travel, 1 through 59 days
prior to departure: 100% of trip cost. Once a trip has departed, there will
be no refunds from Landfall Dive & Adventure Travel for unused portions of
the trip.
CANCELLATION AND REFUND POLICY:
For special dive expeditions where Landfall Dive & Adventure Travel has
chartered the whole boat and/or is offering an escorted program, final
payment is due 90 days prior to departure. At the
time we receive your written cancellation, the following penalties will
apply: Deposit is NON REFUNDABLE. 90 through 1 day prior to departure: 100%
of trip cost. If we are able to re- sell your space, and the trip departs
full, you will be refunded in full less the $100.00 per person
administration fee and any penalties levied by our suppliers. Once a trip
has departed there will be no refunds from Landfall Dive & Adventure Travel
for any unused portions of the trip. Group tours are based on a minimum
number of participants. Should the number of people joining the tour fall
below the required amount, the tour price may increase to ensure your tour
will depart.
TRIP CANCELLATION AND INTERRUPTION
INSURANCE:
Landfall Dive & Adventure Travel strongly recommends the purchase of trip
cancellation/ interruption, accident, and baggage insurance. Landfall
Dive & Adventure Travel has provided an insurance application form or has
directed participants to insurance information available at
www.landfallproductions.com. Also a brochure
describing coverage will be mailed to you with your tour documents.
SHARE POLICY:
Accommodations on all Landfall Dive & Adventure programs are based on double
occupancy. If you are traveling alone and wish to share accommodations, a
roommate will be assigned for you whenever possible. When pairing roommates,
we will always pair participants with the same sex (unless both parties
agrees to share a room with the opposite sex), and make every effort to
accommodate smokers with others smokers. However, if it is necessary to pair
a smoker with a non smoker, overnight accommodations will be made non
smoking for both participants. If it is not possible to pair you with a
roommate, you may be asked to pay a single supplement fee for the land
portion of the program.
MEDICAL INFORMATION:
Participants on a Landfall Dive & Adventure Travel program require that you
are in generally good health. It is essential that persons with any medical
problems and related dietary restrictions make them known to us well before
departure. We can counsel you on whether the trip you have selected is
appropriate for you. The tour leader has the right to disqualify any
participant at any time during the tour if he/she feels the participant is
physically incapable and or if a participant's continued participation will
jeopardize either the individual involved or the group. There will be no
refund given under these circumstances.
Landfall Dive & Adventure Travel its directors, employees, and agents are
not responsible or liable for any injury to persons or property, incurred by
a person or persons caused by the acts of negligence of any establishment,
firm, person, or entity, including, but not limited to airlines, hotels,
dive operators and cruises.
CURRENCY FLUCTUATION:
In order to keep our rates as low as possible, we do not build into the
price an allowance to cover possible increases from currency fluctuations.
Therefore, as currencies do fluctuate constantly around the world it may be
necessary for us to raise the trip cost, at any time before departure, if
there are exceptional cost increases beyond our control.
ITINERARY CHANGES & TRIP DELAY:
Landfall Dive & Adventure Travel reserves the right to change a program's
dates, itineraries, or accommodations as conditions warrant. If a trip must
be delayed or the itinerary changed due to bad weather, road conditions ,
transportation delays, government intervention, sickness or other
contingency for which Landfall Dive & Adventure Travel its directors,
employees, and agents cannot make provision, the cost of delays or changes
is not included.
Participating carriers are responsible only
for the air travel portion of these tours, in accordance with the terms and
conditions of the individual passage contract which is subject to applicable
laws, treaties and regulations governing air transportation.
Participating air carriers may not be held responsible for any act or
omission or event during the time you are aboard the aircraft. The passage
contract used for carriers when issued shall constitute the sole contract
between the carrier and the passenger. In purchasing passage contract you
acknowledge and accept foregoing conditions.
ITINERARY CANCELLATIONS:
Landfall Dive & Adventure Travel reserves the right to modify or cancel
and/or change the price of an itinerary
before departure for any reason whatsoever, including too few participants
or logistical problems such as strikes, wars, acts of God, or any other
circumstances which may make operation of the trip inadvisable. All trip
payments received will be promptly refunded, and this refund will be the
limit of Landfall Dive & Adventure Travel's liability. Landfall Dive &
Adventure travel is not responsible for any expenses incurred by trip
members in preparing for the trip, including non refundable or penalty
carrying airline tickets, special clothing, visa or passport fees or other
trip related expenses.
PARTICIPANTS:
Landfall Dive & Adventure Travel reserves the right to decline any
individual as a trip member for any reason whatsoever. Landfall Dive &
Adventure Travel reserves the right to terminate any individuals trip should
they be a burden to the welfare of the group. Unused portions will be
non-refundable.
GENERAL RELEASE, ASSUMPTION OF RISK,
WAIVER OF LIABILITY AND INDEMNITY AGREEMENT:
This section defines Landfall Dive & Adventure Travel's responsibly with
respect to all of our trips. Please read it carefully.
Landfall Dive & Adventure Travel, its directors, employees, and agents give
notice that they act only as the agent for the owners, contractors, and
suppliers providing means of transportation and/or all other related travel
services and assume no responsibility howsoever caused for injury, loss or
damage to person or property in connection with any service resulting
directly from: acts of God, detention, annoyance, delays, expenses arising
from quarantine, strikes, thefts, pilferage, force majeure, failure of any
means of conveyance to arrive or depart as scheduled, civil disturbances,
terrorism, government restrictions or regulation and discrepancies or
changes in transit or changes in the itinerary may be made where deemed
advisable for the comfort and well being of the passengers. The client
waives any claims against Landfall Dive & Adventure Travel for any
damage to or loss of property, injury or death due to any act of any
airline, hotel, or any other persons rendering any of the services or
accommodations in the itinerary. Landfall Dive & Adventure Travel shall not
be responsible for any delays, substitution of equipment, or any act of
omission whatsoever by the carriers, its agents servants, or employees and
the client hereby waives any claim arising there from. On advancement of
deposit to Landfall Dive & Adventure Travel the depositor acknowledges that
he/she has read and understands the above recited terms and conditions, and
agrees to be bound by them.
Landfall Dive & Adventure Travel does not assume
any responsibility or liability for the safety of any participating
individual while engaged in underwater activities. Landfall Dive & Adventure
Travel has the right to substitute facilities in similar categories. No
refunds will be make to canceled diving arrangements due to adverse weather,
or for substitutions of facilities and/or equipment or for minor
inconvenience once the trip begins.
Applicant certifies the statements made on the reverse regarding Applicant's
experience to be correct and acknowledges that applicant understands that
applicant's on this trip is predicated on applicants assurance that
applicant is physically fit to engage in water sports, including snorkeling
and ocean SCUBA diving, whether alone, in groups, under supervision of an
instructor, tour leader, or otherwise. Applicant certifies that he/she is
aware of the nature of activities relating to SCUBA diving and assumes any
risk involved therein. Applicant represents to Landfall Dive & Adventure
Travel that when he/she engages in underwater activities he/she is
sufficiently experienced and qualified to participate in such activities at
his/her own risk. Applicant voluntarily assumes all
risk of loss, damage or injury that may be sustained while engaged in said
Landfall Dive & Adventure Travel scuba diving travel program.
The undersigned further agrees to release and
absolve Landfall Dive & Adventure Travel, and the agents and employees
thereof from any and all liability resulting from death or personal
injuries, including loss of services, whether resulting from negligence or
anyone in charge of or participating in said SCUBA diving or from the
ownership, maintenance, use, operation, or control of any automobile, ship,
airplane, bicycle, boat, vehicle, inn, hotel, common carrier, or otherwise.
This application signed by applicant and by
the parent or guardian of any minor applicant is in all respects subject to
the terms and conditions above, which have been read and unconditionally
accepted. I/we further agree to observe strictly and comply with such
additional reasonable terms and regulations as the released parties may from
time to time deem desirable or needful or prescribe during the course of the
program. Applicant acknowledges the receipt and review of this agreement and
its binding effect even if not signed and returned by applicant. Undersigned
also acknowledges receipt of a copy of this contract.
