First I give and bequeath unto my daughter Mary Magdalene Baumgardner, One Bed bedstead and bedding, One Breakfast Table, one Bureau, One Spinning Wheel, Two Iron pots, One Sett ladles and flesh fork, One Cow, and half dozen of Chairs.
Second, I hereby authorize and empower my hereinafter named Executor, to sell the Balance of my personal estate in public sale and apply the proceeds thereof to the liquidation of my debts, funeral costs and charges and getting two pair of gravestones one pair for myself and one pair for my deceased wife Magdalene and the erection thereof at our respective graves.
Thirdly, I hereby authorize and empower my hereinafter named Executor to sell, all my Real Estate, lying in Carroll County Maryland after the most judicious manner, at private or public sale, and to convey the same by good and sufficient deeds of Bargain and sale the said Real Estate to the purchaser or purchasers, and the money arising from the sale thereof, surplus in the hands of my Executor I will as follows
First, Two hundred dollars to my Daughter Mary Magdalene Baumgardner.
Secondly, Fifty dollars to Matilda Sullivan as a compensation in full for services rendered.
Thirdly, To Peter Kaes who was intermarried with my daughter Elizabeth One dollar, in addition to what he has heretofore received from me, as his share in full of all my estate Real personal and mixed.
Fourthly and lastly, the Balance or residue I will and bequeath to my sons Jacob Baumgardner, John Baumgardner, Samuel Baumgardner, Josiah Baumgardner, and my daughter Mary Magdalene Baumgardner Share and Share alike.
And lastly I hereby nominate constitute and appoint my son John Baumgardner, as my Executor of this my last will and testament

Maryland Carroll County to wit: On the 28th day of September 1846, Before the Orphans Court for Carroll County came Joseph Wivell the person who exhibited the aforegoing instrument of writing, and in open court made oath in the Holy Evangely of Almighty God, that the same is the whole and true and last will and testament of Jacob Baumgardner, late of Carroll County deceased, that hat come to his hands and possession; that he received the same from the testator for safe custody, and that he does not know of any other will left by said deceased.
