Rejects NSPS: An Analysis of the Decision

Counsel Jean Zeiler provides an important
analysis of Judge Emmet Sullivan's decision
In a great success for
the rights of DoD unions and workers, U.S.
District Court Judge Emmet Sullivan issued his
decision on the union lawsuit challenging the
NSPS regulations on February 27, 2006. The
decision permanently enjoins the DoD from
implementing regulations on adverse actions,
appeals, and labor relations. The DoD may submit
a proposal to the Judge to allow selective
implementation of labor relations regulations,
but the chances of meeting the Judge’s
conditions are slim.

In a stunning victory
for DoD employees and their unions, federal
district court judge Emmett Sullivan ruled in
favor of the United DoD Workers Coalition (UDWC)
by blocking the DoD's plan to implement several
portions of the National Security Personnel
System (NSPS) beginning next month.

Since the NSPS
regulations were published last year, FUSE, NAGE,
and the other unions in the UDWC have been
trying to point out how blatantly unfair and
unlawful the NSPS regulations really are. We've
heard quite a bit of skepticism from many
people, including some of the employees that
these regulations are targeted at.

Coalition Unions Score Considerable Victory on
NSPS Front

Judge Emmet G. Sullivan
handed down a ruling today in the Department of
Defense's new personnel system that clearly and
significantly favors the union's position.
According to NAGE Legislative Director Steve
Lenkart, who is also the legislative director
for the coalition, NAGE and the other unions won
at least 80 percent of what we were going after.

In a huge setback
to the Administration's attack on unions and collective bargaining,
the federal court ruled on Friday that new personnel regulations for
the Department of Homeland Security violate rights and protections
that form the backbone of civil service laws. The decision of the
court has sent shockwaves reverberating throughout the federal
sector as the model for NSPS, which is the new personnel system
proposed for the Department of Defense, was struck down.
