Dear Mr. Benjamin,

I would like to commend you on your creation of an application which could enable a follower of the Weight Watchers® 1·2·3 SUCCESS® plan to calculate POINTS®. You have entitled this program "Weight Watchers' PointsFinder".

Weight Watchers International, Inc. are very proud of the innovations we have been able to create in helping individuals achieve their personal successes over the past 37 years, most recently with our 1·2·3 SUCCESS plan and POINTS based diet.

Our staff at Weight Watchers have spent countless hours developing and creating methods to help people help themselves. One of these methods is the POINTS system, which is a proprietary method for calculating food values. This method is now the subject of a patent. As you might be aware, a patent provides an inventor certain rights which the law protects. We feel that your use infringes on our trade rights, and displays unfair competition since you are not the rightful owner of these trademarks or patent.

We ask that in light of our ownership of the patented POINTS process you

immediately remove the application from your webpage http://members.home.net/pbenjamin/ww/pointsfinder.html

and refrain from misrepresenting our POINTS® and PointsFinder® trademark.
