"A writen will and testament of James Jolly. I, James Jolly of the County of roane and State of Tennessee, do make and publish this my last will and testament hereby revoking and making void all other wills by me at any time made, - -
First, I direct that all my funeral expenses and all my debts be paid as soon after my death as possible out of any moneys that I may die possessed of or may first come into the hands of my executors - -
Secondly, I give and bequeath to my beloved wife Mary, all the house - my furniture and home place and the black girl Veati, and any two nags of her own choosing that I may die possessed of and as many Milk cows and other stock as she may wish for her own use during her natural lifetime all of which at her death I bequeath to my beloved daughter Rebecca and her heirs (to wit) the wife of Hardin Deatherage - -
Thirdly, Believing my son William not to be of sufficient capacity of mind to manage his affairs I therefore direct that the remainder of my lands be rented out and the profits of the same or so much thereof as may be necessary to be applied to the suport and benefit of my said son William during his natural lifetime and at his death the said lands and the remainder of the profits after keeping up the fences and paying other necessary expenses if there be any remainder I direct to be equally divided between the heirs of my above named daug. Rebecca Deatherage - -
Fourthly, I direct that of the moneys I may die possessed of my executors shall purchase a man servant if they can find a suitable one. which servant is to be used for the maintainance and benefit of my of my afore named wife Mary, and at her death to belong to my daughter Rebecca and in case a suitable servant canot be bought then the money is to go to the benefit of my daughter Rebecca and her heirs.
Fifthly. I direct that the wagon and gearing be kept for the use of the farms and the remainder of the property, not otherwise appropriated in this will to be sold and the money arising from the same to be applied as follows (to wit) fifty dollars to Mary Ann Deatherage and fifty dollars to James Deatherage both being the heirs of my daughter Rebecca afore named and the remainder of the said money if there be any to equally divided between all her heirs when they arrive at twenty one years of age - -
Sixthly, The expressions in the second article of this will are so to be understood that the black girl Veati and her increase are to belong to my daughter Rebecca at the death of my wife Mary, - -
And Lastly, I do hereby nominate and apoint Hardin Deatherage and John E. Deatherage my executors and direct that they collect all my outstanding debts - and request them to become the guardians of my son William - In witness whereof I do to this my will set my hand and seal this the 18th day of December 1848.

Will of Hardin Deatherage from Roane County, Tennessee Estates-Hardin Deatherage 1875
I Hardin Deatherage do make this my last Will and Testament hereby revoking and making Void all other by me at any time made.
First I direct that my funeral expenses and all my debts be paid as soon after my death as possible out of any moneys that I may die possessed of or may first come into the hands of my executor.
Secondly I give and bequeath to my wife Rebecca Deatherage the home farm as willed to her by her father James Jolly deceased. All the household and kitchen furniture all of the farming tools of every description the growing crop I may have in cultivation myself on all my lands my waggon and gearing blacksmith tools and also all mechanical tools and what provisions and grain may be on hand at my death and as much of the Stock of all kinds as She may wish to keep and at her death Whatever may be left of it to be equally divided between her following named Children Viz Mary A. Durham Nancy Guffee Sarah Ann Williams and Henderson Deatherage.
Thirdly it is my wish and bequest that my Son Henderson Deatherage before any division of personal property be made as named in the preceding Clause, be allowed to keep the Horse I have given him and also alike amount of other property and money as have been advanced to the other above named heirs then the remainder be equally divided among the above named heirs.
Fourthly Whenever there can be a sale or division made of the Lands Willed by James Jolly to the heirs of the said Rebecca Deatherage then its my wish that my lands and all money that may be in the hands of my executors be divided equally amongst my above named Children Viz Mary A Durham Nancy Guffee Sarah Ann Williams and Henderson Deatherage.
Lastly its my request that the heirs Select an executor to this my last Will and Testament and if my wife Should need anything more at anytime than I have provided for her in this Will, that he administer to her necessities out of any moneys he may have on hand and also provide for Wm Jolly and see that he is cared for as provided in the will of his Father and if Sale or division is made of the Lands Whoever may get that portion Owned by me Contribute Equal with the balance for his Support.
In witness whereof I hereunto set my hand this 20 day of April 1874.

102. ANDREW JACKSON DEATHERAGE

"William Deatherage,"History of Fulton Co., AR, p.280 William Deatherage, one of the foremost farmers of Mount Calm Township, on Bennett River, owes his nativity to Tennessee, where he was born in 1842. His father, A. J. Deatherage, was born in Tennessee, about 1811, and died in Roane County, of that State, in 1847. The latter was married in his native State to Miss Sarah Jackson, also a native of Tennessee, born about 1822. Three children were the result of this union, William being the eldest. One was drowned in the Tennessee River, by the overturning of a skiff, when only seven years of age, and Martha, became the wife of O. B. Fuller, and is now living in Tennessee. Mrs. Deatherage was married the second time, in 1850, to W. F. Ellis, and by this union became the mother of eight children, six daughters and two sons: Sarah (deceased), Margaret (deceased), Minerva, wife of George Jones, and now living in Tennessee; Nancy and Becky (twins), were married to twin brothers, Samuel and Elijah Kelon, and live in Tennessee; Caleb, Franklin, and Mary, at home with her mother. A. J. Deatherage was a major in the United States army when the Indians were moved to Indian Territory.
William Deatherage commenced for himself in life by joining the Confederate army, Company A, Twenty-sixth Tennessee Infantry Regiment, on the 15th of June, 1861, and served about four years. He participated in sixteen hard-fought battles, the principal ones being Fort Donelson, Murfreesboro, Chickamauga, Missionary Ridge, Taylor Ridge Gap, Swamp Creek, Resaca, New Hope, Marietta, Jonesboro, Columbia, Franklin, Nashville; was with Forrest at Murfreesboro the second time, Columbia. Bentonville, Chickasaw Mountain, etc. He surrendered on the 5th of April, 1865, at Greensboro, N. C., after which Mr. Deatherage returned to Greeneville, Tenn., and from thence home, where he commenced farming. He started out after the war with nothing but a Confederate suit of clothes, with forty-eight bullet holes in it. He was married, May 28, 1868. to Miss Rebecca Hall, of Tennessee, and in the fall of the following year he came to Fulton County, and settled on Bennett's Bayou, and there remained three years. In 1873 he moved to his present fine property. consisting [p.281] of 267 acres, with 100 acres improved. He has good buildings, and a comfortable home. As he has had but little help since commencing for himself, he is the architect of his own fortune. To his marriage were born eleven children, eight living at present: Susan, born October 12, 1870; E. J., born February 9, 1872; G. W., born on the 3d of September, 1874; Lydia M., born on the 8th of September, 1876; Sarah A., born on the 5th of December, 1878; W. S., born on the 5th of March, 1880; James K. P., born on the 12th of October, 1885, and Nancy, born on the 11th of June, 1888. Mr. Deatherage has been justice of the peace of his township for one term. He is a member of the Masonic fraternity, County Line Lodge No. 373, and in his political opinions is with the Democrats. Mrs. Deatherage is the daughter of Elijah and Lydia Hall, who were the parents of eleven children, the following living: Samuel, Elisha, Mollie, Elijah, Lydia, Thomas, Rebecca D. and J. K. P.

26 Jan 1835: "The court proceeded to elect constables in the following Companies in said County for the two ensuing years towit. … In Capt. Burnetts Company Andrew J. Detherage was elected … and the severally entered into bond with security and took the several oaths prescribed by law and were accordingly qualified." (Roane County, Tennesseee County Court Minutes 1832-1835, Pg.329)

2 May 1836: "The certificates of the election of constables for the county of Roane was by the Coroner & Sheriff filed with the clerk and thereupon appeared in open court … Andrew Deatherage … who executed each their bond with securitys conditioned as the law requires and took oath to support the constituation of the United States & of the State of Tennessee and on an oath prohibit dueling also an oath of office & being thus qualified was permitted to enter upon the duties of their offices." (Roane County, Tennesseee County Court Minutes 1836-1840, Pg.58)

2 Jan 1837:"The resignation of A.J. Deatherage one of the constables for Roane County having tendered his resignation was accepted by the court." (Roane County, Tennesseee County Court Minutes 1836-1840, Pg.118)

6 Mar 1837: "Malcolm McDuffee who had been elected a constable for the county of Roane to fill the vacancy occasioned by the resignation of A.J. Deatherage appeared in court …" (Roane County, Tennesseee County Court Minutes 1836-1840, Pg.132)

4 Apr 1842: "Ordered by the court that the Sheriff of Roane County Summon the following named persons good and Lawful men citizens of said County to attend at the Court house in Kingston the 4th Monday of June next as Jurors to the Circuit Court then and there to be held for the county of Roane towit. … 10th District Andrew J. If Nathan's tombstone is correct that is not likely as he was born about Sep 1848. Charles W. Deatherage, son of #116 William L. and Nancy A. (Turner ) Deatherage, was born 22 Mar 1858.
Marlene Shake thinks that the poem "Achilles Deatheridge" written by Edgar Lee Masters was about Achilles, son of this William.

If Nathan's tombstone is correct that is not likely as he was born about Sep 1848. Charles W. Deatherage, son of #116 William L. and Nancy A. (Turner ) Deatherage, was born 22 Mar 1858. It is more probable that he is the son of #105 William and Nancy Harrison (Gunnels) Deatherage in whose family I have placed him.
Of his children Elizabeth, Lydia F., George N., Mary Emma and Clara Ellen are buried at Rogers Cemetery, Morgan Co., IL.
