On this 29th day of Jannary 1833 personally appeared in open
Court before William Clark Eblen, William Galbreath & George
Gains, it being a court of Reccon., now sitting as a gon__ court
a resident of the County of Roane and State of Tessessee aged
about 68 years who being first duly sworn according to law, doth,
on his oath make the following declaration, in order to obtain
the benefit of the act of Congress passed June 7th 1832, That he
entered the service of the United States under the following
named Officers and served as herein stated,
Applicant entered the service as a volunteer under Captain Joseph
Philips, Maj George Winston, Col John Cleveland, that he lived in
Surry County North Carolina where he entered the service which
was as well as reccollected in the year 1779. Applicant
volunteeered for three months the first time and was marched from
Surry County to Wilmington, there was out on scouting parties
until the three months, [illegable] recived a written discharge
from Capt Joseph Clone.
Applicant then went home where he remained but a short time when
he volunteered was drafted for three months. Applicant was
marched near Wilmington where they had some skirmishes with the
British and Torys. Applicant was continued in service about five
months when he was discharged again by Capt Joseph Clone.
Applicants Sup. Officers in this last service were Maj George
Grimes & John Smith was the Colonel.
Applicant returned home again where he remained about two months
when he was drafted again by the same Captain Clone for the term
of four months was marched near Wilmington where they were
stationed, out frequently on scouting parties through the lower
parts of North Carolina & sometimes in South Carolina. Was in
no general engagement. Applicant continued to serve out the four
when he was discharged by Captain White. Applicant returned home
where he remained a short time was drafter again by Captain Clone
for the term of three months was marched through the lower parts
of North Carolina & south on scouting parties served out the
time when he was discharged by Capt Clone. Returned home again
where he remained for some time. Had an engagement above
Wilmington with the Tories the last month was out.
Applicant in part of said service belonged to General Rutherfords
regiment. Applicant has no documentary evidence of his service as
his discharges are lost and that he knows of know person whose
testimony he can procur who can testify to his service. Applicant
was born in the year 1765 State of North Carolina Surry County
where he continued to reside until he moved to Tennessee.
Applicant is acquainted with the following persons who can
testify that he is a man of sencerity and that they believe that
he [illegable] as he has states to wit Captain Stone, Joseph
Bryant Esq, Thomas Stocton Esq, Josiah Patty Esq. He hereby
relinquishes every claim whatever to a pension or annuity except
the present and declares that his name is not on the pension roll
of the agency of any state.

neighborhood whom he regards to have been a soldier of the
revolution and that we concur in that aforesaid.

investigation of this matter and after putting the interrogation
prescribed by the war department that the above named applicant
was a revolutionary soldier and George Lutrell who has signed the
preceeding certificate is a clergyman resident in the County of
Roane and that Thomas Peircy who has also signed the same is a
resident of the County of Roane and is a credible person and that
their statement is [illegable] to credit.

"James Y. Matheny is my gg grandfather. 30 years ago I was told the family thought Jimmie Y. 's father was Elijah Matheny. However that proved to be false information. For years I thought James M. Matheny, Elijah's son, might be Jimmie Y. father. He was married to Elizabeth Deatherage but left her and ran off with her brother, James Deatherage, wife Elizabeth Ahart Deatherage to S.C. or so said James
Deatherage in his Divorce Complainant filed 27 Mar 1843. James Deatherage & Elizabeth Deatherage Matheny had a sister named Nancy who married William Jolly. I don't know when he died, but wouldn't think Nancy would have changed her name back to Deatherage?? I have wondered if James Y. may be a
illegitimate son of James M. or his brother John A. Matheny. I have been to Jimmie Y. (that seems to be what the family called him) and Phoebe (her headstones spelling) grave in Putnam County Tennessee. I have been to a lot of the old Matheny's there but no one knows how Jimmie Y.'s parents were.( Sid Matheny Ltr., 19 Feb 2000).
We know that Bird had two nieces, Elizabeth and Lucinda that married Mathenys; so it would seem reasonable that an older single daughter of Bird Deatherage might be living with a Matheny family after her father removed to Arkansas.
We have not established the parents of James Young Matheny. My thought was that the most logical parents would be #82. James and Elizabeth Deatherage Matheny. However, from the following court case, it would appear that James and Elizabeth only had the three children; Samuel R.S., Abner Deatherage, and Chrissy H. Matheny. In the following transcription Elizabeth is the wife of James Matheny; A.D. Matheny and Chrissy Matheny Lewis are Elizabeth’s children; Nancy Patterson is the former widow of Samuel R.S. Matheny, who died in 1863. Nancy was married to James D. Patterson in 1866. Charles Alveyn, Henry Levaca and Cornelius Worth Matheny are the children of Samuel R.S. and Nancy Bowman Matheny. In this court case there is no mention of James Y. Matheny as an heir of Elizabeth or sibling of Samuel R.S. Matheny.
"…that all the interest and title which Elizabeth Matheny, J.M. Patterson and wife Nancy, Charles Alveyn, Henry Leveca & Cornelius Worth Matheny have in and to the lot of land above allowed to A.D. Matheny and Chrissy Lewis be divided out of their [illegible] and each of them and [illegible] and the said A.D. Matheny and Chrissy Lewis as tenants in fee simple and common, and it is furthered ordered and adjudged and decreed that all the interest and title which John Lewis, Chrissy Lewis, A.D. Matheny, Elizabeth Matheny, J.M. Patterson and wife Nancy have in and to the lot of land above allowed to Charley Alveyn, Henry Leveca and Cornelius be divided out of….. Nov. 11, 1873" (Roane Co., TN. Chancery Court 1873 Loose Papers, A.D. Matheny & others vs. Elizabeth Matheny & others).
The census enumerations for Nancy present more difficulties:
1850: Nancy MATHENY, age 48
1860: Nancy BETHERAGE, age 50
1870: Mary DETHEDG, age 67
I believe this is the same person; Nancy Deatherage, born c1802 in Tennessee. The census enumerator probably assumed she was a Matheny in 1850 and was not familiar with the Deatherage surname in 1860 and 1870. Eliminating the age in 1860; the ages in 1850 and 1870 are very close. I can not explain why she was listed as Mary in 1870.
The only other Nancy Deatherage in this age range is Nancy Deatherage Jolly, # 83 iii.,the daughter of #25, Abner Deatherage. Since Abner Deatherage’s family is much better documented than the family of Bird; I believe we have this Nancy correctly placed.
The last clue from the census records is the listing of Lucy Snow, age 21 in this family in 1870. This most probably is the daughter of Benjamin and Martha Deatherage Snow. Martha was the daughter of #25, Abner Deatherage.
Why was this family in Overton Co, TN ? Elizabeth and Lucinda Deatherage married brothers, sons of Elijah Matheny. John Anderson Matheny who married Lucinda Deatherage lived in Jackson Co, TN., which borders Overton Co.,TN. on the west in 1850-1870. Another son of Elijah Matheny, Samuel Davis Matheny, lived in Jackson Co., TN in 1850 and in Overton Co, TN. In 1860. I also believe there was a deeper connection to the upper cumberland area of Middle Tennessee which relates to the Dalton’s that will be discussed under #24.viii.,Eliza Deatherage Graham. In a response dated 26 Aug 1842 by Thomas Brown, Austin L. Green, his deputy, to the court order to determine the amount due each child of the estate of Abner Deatherage: ".....being divided between 15 children is the sum to each child $77.70 cents. There being six children by the last wife....." (Roane County, Tennessee Chancery Court, 28 Sep 1841). Also in the petition to the court filed 5 Apr 1841 : ".....that a certain Abner Deatherage departed this life sometime in 1838 then a citizen of the county of Roane without making any will leaving all the complainants the legal heirs and representatives of him the said Deatherage by his first wife who departed this life sometime perhaps in 1823 and said Abner some time afterwards married his second wife and at the death of the said Abner he left his second wife his relic and widow, Elizabeth, and these other children by his last wife to wit, Allen, Sally, Jennett, Nelly, Rebecca and John Deatherage all the last mentioned children are minors ....." (Roane County, Tennessee Chancery Court, 28 Sep 1841).
From the guardianship bond of the minor children of Abner Deatherage, dec. " Know all men by these presents, that We, John Jolly and Alexander Deatherage are held and firmly bound unto ........ signed with our seals and dated this second day of February 1846. The condition of the above obligation is such, that, whereas, the above bound John Jolly has this day, by the court aforesaid been appointed Guardian to Jennetta, Nelly, Rebecca & John Deatherage, minor orphans of Abner Deatherage , dec." (Roane Co, TN Guardianship Files-1846). Appears Alexander Deatherage and his brother in law, John Jolly, signed the bond for John Jolly's performance.

Before he died Alexander Deatherage had been declared an "imbecile" and Samuel Snow was appointed his guardian. In the settlement of Alexander's estate the only distribution was to his guardian and nephew Samuel Snow.

and W. D. Browder and his wife Sarah Ann Browder, formerly Sarah
Ann Deatherage, of McMinn County and said State, bring this
petition against William Deatherage and Martha Deatherage, infant
children of A. J. Deatherage, deceased and against William Ellis
their regular guardian"
Third Paragraph "....... Some months ago the said George W.
departed this life intrstate in the County of Roane, and
administration has been granted on his estate. Said estate is
unencumbered, there being no debts of any consequence. The
personal estate will be more than amply sufficient to satisfy all
just claims. The said George W. left neither wife nor child, and
the said Philemon, his father, is his only distribution, The
other petitioners and the infant defendents are his only heirs at
law. .........."
Biographical Appendix of Meigs County, Tennessee, biography of
W.D. Browder, Sr, husband of Sarah A. Deatherage. Gives their
marriage date, states she was born in Madison Co., KY, on 20 Oct
1823, and that she was a Methodist.
Sarah Ann 20 Oct 1823 (Meigs Co, Tn Cemetery Records) - living
1900 (1900 Census, Meigs Co, Tn. - family 7-68A-96). No death
date on Tombstone. Sarah Ann married William Dixon Browder,Sr,
son of William and Elizabeth (Lackey) Browder on 30 Mar 1815 in
Roane Co, Tn, James Sewell M.G., Surety, James H. Pickel
(Lackey-Browder Bible and Marriage Records Roane County Tennessee
1801-1855 and County Records MB 1, 133-134, bond and licence).
William was born 25 Jan 1823 in Roane Co, Tn and died 17 Jan 1906
(Meigs Co, Tn Cemetery Records). Both William and Sara are buried
in the Deatherage- Pickel Cemetery, Meigs Co, Tn.
"W. D. Browder,Sr ...........Our subject, the 3rd of 8
children, was educated in the common schools and left his
father's farm when 21 years of age. He rented for 2 years and
then bought a farm in Roane County of 280 acres; he lived on his
627 acres in McMinn County for 8 years and after 5 years on
another farm of 610 acres in Sweet Water Valley. He rented land
in Williamson County for 4 years. After renting a year in Meigs
he bought 320 acres, and his father-in-law gave his wife 203
acres, making the farm on which he know lives. He is a Democrat,
Mason, Methodist and Prohibitionist. October 24, 1844, he married
Sarah A., a daughter of Philemon and Martha Deatherage, who was
born in Madison County, Ky., October 20, 1823, also a Methodist.
Our subject improved and made money on his farm, but was ruined
financially by the war." (History of Tennessee: 30 East
Tennessee Counties).
William and Sarah are in the 1850 Roane Co, Tn Census (family
1398) with no children and in the 1870 Roane Co, Tn Census with
no children (family 14-14, PO Ten Mile Stand). In the 1880 Roane
Co, Tn Census (family 203-207, Tenth District), they now have two
sons, William age 8 and John age 4. Sarah is now 56. The mother
of both sons is listed as born in Tennessee, while Sarah is
listed as born in Kentucky.
Either these children were born late in their married life or
they were adopted.

i. William F. Jan 1871- living 1900 (1900 Census, Meigs Co, Tn. -
family 7-68A-96) married Addie Mary Martin on 18 Jun 1893 in
Roane Co, Tn, Hardin Deatherage Jolly, J. P. (Marriage Records
Roane County Tennessee 1881-1900).
ii. John T. Oct 1875 - living 1900 (1900 Census, Meigs Co, Tn. -
family 7-68B-97) married May Clark on 28 Dec 1898 in Roane Co,
Tn, J. S. Denham, J.P. (Marriage Records Roane County Tennessee
1881-1900).
