Anstice Foote is the same Peter Ware of York Co.,
Virginia,
the following information is provided.
I was unable either prove or disprove this Devon Peter Weare
/ Ware
is
the same Peter Ware who immigrated to York Co., VA.
Crediton
is southwest of Exeter and St. Sidwell in Exeter is where
Peter Weare / Ware married Anstice Foote.
Honiton
Clyst or Clyst Honiton (both ways are used) is a short
distance from St. Sidwell as is Halberton.
On

Jul 1646 a Peter Weare married Mary Sargeant at St. Paul’s
Parish, Exeter, could this be Mary Hickes?
It’s
possible she remarried prior to attending Orphan’s Court,
but was still referred to as the widow of Peter Ware.

"Whereas John Weare, of Silferton,
in the County of Devon, Esquire, Counsellor at Law, and John
Weare his Son, have by both Houses of Parliament been
admitted to their Fine of Five Hundred and Twenty-six
Pounds; the Father having been a Commissioner of Array, and
assisted the Forces raised against the Parliament; the Son
having been in Arms against the Parliament: The Lords and
Commons assembled in Parliament do hereby authorize and
appoint His Majesty's Solicitor General to prepare a Pardon
to the said John Weare Senior, and John Weare his Son, for
their said Offences, in such Form as is agreed by both
Houses for like Offenders, together with a Grant of, and
Restitution to them, their Heirs and Assigns, of all their
Lands, Goods, and Chattels, and other Estate for which the
said Fine was accepted, according to a Particular thereof
made, and entered with the Committee at Gouldsmiths Hall,
and of all Mean Profits thereof, from the 31th Day of July,
1646, with an Exception of the Right or Estate of the said
John Weare Senior, and John Weare Junior, in or to all
Advowsons, Presentations, and Right of Patronage, to any
Church or Chapel; which said Pardon, so prepared, the
Commissioners of the Great Seal of England for the Time
being are hereby likewise authorized to pass under the said
Great Seal accordingly: Provided always, That this
Ordinance, or the said Pardon thereon to be passed, shall
not extend to free the said John Weare Senior & Junior
from a further Composition, for any other Lands, Goods, or
Chattels, than what are contained in the Particular
aforesaid; and that, in case the said Lands mentioned in the
said Particular were of greater Yearly Values than are
therein expressed during Three Years before the Year of our
Lord 1640, then the said John Weare, and John Ware his Son,
shall pay such further Fine, by Way of Composition, as both

M050511, 6930446. Peter Ware and Anstice Foote
married in 1624, giving Peter an estimated birth year of 1603.
They had at least 8 children prior to their last IGI
recorded child in 1639. If there were additional
children after 1639, their birth was not recorded, as
we already know this happened to Jane as she is
shown as a daughter of Peter and Anstice in the will
of Johan Foote, but is not in the IGI record.
Nicholas Ware is first
documented in Virginia in 1660: Peter Ware (Jr.) and
Nicholas Ware signed as witnesses of a deposition given by
Francis Carpenter, for Thomas Bucke's estate. (VSLA,
York Co. VA Records 1659-1662). From this it was assumed
he was born about 1639, but there is no reason he
could not have been 18 at the time he witnessed this
deposition, (or born 1642). It is somewhat
puzzling why Peter Ware is not mentioned as being in
Virginia by Johan Foote, as his will is written in 1647,
and Peter was clearly in Virginia by that time. [1646 - 4
Sep - Peter Ware and Thomas Gibson inventory estate of John
Davis, Sr. of Queen's Creek, York Co., VA, estate totaled
3066 lbs. Tobacco. (Beverly Fleet, VA. Colonial Abstract
25, York Co. Page. 19)]
Peter Ware, Jr. was
clearly age 21 by 1660, as the following is recorded:
In 1660 Peter Ware (Jr.) was appointed assistant
constable to William Baker of the Upper Precinct of Hampton
Parish (VSLA, York Co. VA Records 1659-1662), so we know he
was born before 1659. This was also definitely Peter
Ware, Jr., as Mary Hickes was in Orphan's Court prior to
this date, placing Peter as being born prior to his
sister Mary. I still don't fully understand why
Mary Hickes was referred to as widow of Peter Ware, but not
referred to as Mary Ware if they were from Crediton, Devon,
England. I guess it's possible Peter married her in
York Co., and she was from an area where it was customary
to keep her maiden name, or she had remarried and the
record failed to address her in that manner.
While this Peter Ware is the
top runner to be the same Peter Ware who settled in York
Co. due to the naming pattern of the Crediton Ware's, and
the age of this Peter Ware, it's still puzzling why
Johan Foote only names two of his daughter's children in
his will. We clearly know that Peter and
Nicholas were alive in 1647. It is also puzzling why Johan
gave the token sum of 1 shilling to Peter, which is
the same amount he bequeathed to the younger daughter
Jane. I know it is said that Johan Foote's will
was found recorded in early records of York Co.,
Virginia, I have been unable to document this as being
true.
