Guest License for Spiritual Retreat

This license agreement made by and between The Paracelsian Order, Inc., D.B.A. Madre Grande Monastery, hereinafter referred to as the Licensor, and visitors, guests, and invitees, hereinafter called the Licensee.

WHEREAS, Licensor is the owner of certain real property commonly known as 18372 Hwy. 94, Dulzura, CA., more particularly described in that certain Grant Deed recorded in the Office of the San Diego County Recorder as document number 1997-0082874 on February 25, 1997.

WHEREAS, Licensee desires to obtain permission to non-exclusive use of Licensor’s property for spiritual retreat, following the rules and regulations thereof.

Now, therefore, it is agreed as follows:

LICENSE: This is not a tenancy agreement and is terminable by the Licensor at any time and for any reason, and the Licensee shall neither have nor acquire any tenant rights. Licensor grants to Licensee the right to use Licensor’s property for spiritual retreat.

USE: The retreat facilities are available to licensed persons only, including adults and their minor children. All persons must be registered and agree to this license before they will be permitted to remain.

HOUSE RULES: Licensee agrees to abide by any and all house rules whether promulgated before or after the execution of this license agreement, including, but not limited to, rules with respect to personal property, noise, odors, disposal of refuse, animals, parking, children, and use of common areas. Please refer to MADRE GRANDE MONASTERY GUEST INFORMATION AND GUIDELINES, which is posted.

TRANSFERABILITY: This license is personal to the Licensee and his or her minor children. It is non-assignable, and any attempt to assign this license terminates it; therefore, Licensee may not invite other persons for use of the property, and any such person shall be trespassing and may be treated accordingly as the law permits.

MAINTENANCE OF FACILITY: Licensor may at any time give Licensee a written inventory of personal property on the premises which are to be in possession of Licensee during the term of the license, and Licensee acknowledges that such property is in good order and repair. Licensee shall, at their own expense, and at all times, maintain the premises in a clean and sanitary manner including all such inventoried personal property, and shall surrender the same, at termination hereof, in as good condition received, normal wear and tear excepted. Licensee shall be responsible for damages caused by their negligence and that of their family members and trespasser invitees. Licensee shall not commit any waste upon said property, or any nuisance or act which may disturb the quiet enjoyment of the Licensor or any other Licensee.

INDEMNIFICATION: Licensor shall not be responsible for any damage or injury to licensee, or any other person, or to any property, occurring on the premises or any part thereof, unless such damage is the proximate result of the negligence or unlawful act of the Licensor, its agents, or its employees. Licensee agrees to hold Licensor harmless from any claims for damages, no matter how caused, except for injury or damages for which Licensor is legally responsible.

ATTORNEY’S FEES: In any legal action brought by either party to enforce the terms hereof, or relating to the licensed premises, the prevailing party shall be entitled to recovery of all costs incurred in connection with such action, including reasonable attorney’s fees.

WAIVER: No failure of Licensor to enforce any term hereof shall be deemed a waiver. The acceptance by Licensor shall not waive its rights to enforce any term hereof.
